SkinAct Warranty Program (Laser & IPL Units)

Extended Warranty + Loaner Protection Program for SKINACT lasers and IPLs units

Protect your investment beyond the included standard warranty with optional extended coverage and temporary loaner support for eligible professional-use laser and IPL systems. This program is designed to help reduce business interruption during approved covered repairs, subject to the terms and conditions below.

1. Eligibility

The Extended Warranty + Loaner Protection Program is available only for eligible equipment and only to customers who purchase an applicable extended warranty plan from SKINACT INC. or its authorized sales channels. This program is not included with the standard manufacturer or seller warranty unless expressly stated in writing at the time of purchase.

Loaner support is available only during the active term of the purchased extended warranty plan and only for approved covered repair claims.

2. Standard Warranty Does Not Include Loaner Support

Any standard included first-year warranty, if applicable to the product purchased, does not include loaner service, temporary replacement equipment, business interruption coverage, or downtime protection unless expressly stated otherwise in writing. Loaner support is a separate benefit available only under an eligible purchased extended warranty plan.

3. Covered Loaner Events

A loaner unit may be offered only when all of the following conditions are met:

  • the customer has purchased and maintains an eligible extended warranty plan;
  • the original covered equipment has been reported to SKINACT INC. for service;
  • SKINACT INC. determines, in its sole discretion, that the issue qualifies as a covered repair event under the applicable warranty terms;
  • the customer has completed required troubleshooting and support steps requested by SKINACT INC.;
  • a comparable loaner unit is available;
  • the customer has signed all required loaner documentation; and
  • the required temporary refundable security charge has been successfully processed.

Loaner units are not guaranteed and are always subject to availability.

4. Loaner Unit May Not Be Identical

Any loaner unit provided under this program may differ from the customer’s original machine in appearance, model, configuration, age, software version, accessories, handpieces, interface, features, specifications, treatment presets, treatment capacity, or other characteristics. SKINACT INC. does not guarantee that a loaner unit will be identical to, or fully interchangeable with, the customer’s original equipment. A loaner unit, if provided, is intended only as a temporary substitute as determined by SKINACT INC. in its sole discretion.

5. Temporary Refundable Security Charge

Before any loaner unit is shipped or released, the customer must pay a temporary refundable security charge in the amount specified by SKINACT INC. at the time of approval. This charge is intended to help secure the timely return of the loaner unit and all included accessories and to protect against loss, damage, misuse, late return, missing components, cleaning costs, freight-related losses, and other amounts due under this program.

The temporary refundable security charge will be refunded after the loaner unit is returned, received, inspected, and confirmed by SKINACT INC. to be in acceptable condition, ordinary wear excepted, less any applicable deductions. SKINACT INC. may deduct from the temporary refundable security charge any amounts owed for late return, damage, misuse, missing items, excessive wear, cleaning, repair, replacement, shipping, handling, or other charges permitted under these terms. If the customer’s obligations exceed the amount of the temporary refundable security charge, the customer remains responsible for the full unpaid balance.

6. Limited Temporary Replacement Use Only

Any loaner unit is provided solely as a temporary replacement for the customer’s out-of-service covered unit during an approved covered repair event. The loaner unit is not provided as an additional, supplemental, overflow, backup, expansion, or revenue-maximizing unit.

The customer may use the loaner unit only for ordinary, intended, and reasonably comparable professional operation to the customer’s original covered equipment and only to maintain normal business continuity during the repair period. The customer may not use the loaner unit for excessive, abusive, abnormal, unusually intensive, expanded-volume, or unintended purposes.

Without limitation, the customer may not use the loaner unit to:

  • increase business capacity beyond ordinary replacement needs;
  • operate as an extra machine in addition to the original covered unit if the original unit remains functional;
  • support multiple locations or mobile operations unless expressly approved in writing by SKINACT INC.;
  • train unrelated third parties or otherwise use the machine for purposes unrelated to temporary replacement of the original covered unit;
  • operate the machine beyond ordinary and intended professional use; or
  • use the machine in any manner inconsistent with safety instructions, operating protocols, or product limitations.

SKINACT INC. reserves the right to determine, in its sole discretion, whether use of a loaner unit is reasonable, excessive, abusive, abnormal, or inconsistent with the purpose of this program.

7. Customer Responsibilities for Loaner Equipment

The customer is fully responsible for the loaner unit from the time it leaves SKINACT INC.’s possession until it is returned to and accepted by SKINACT INC. The customer agrees to:

  • use the loaner unit only in a professional setting and only for lawful business purposes;
  • ensure that the loaner unit is operated only by trained, qualified, licensed, or otherwise legally authorized personnel, as applicable;
  • follow all operating instructions, safety guidelines, warnings, treatment protocols, and product limitations;
  • inspect the loaner unit immediately upon delivery and report any shipping damage or issues promptly;
  • keep the loaner unit secure, protected, clean, and in good operating condition;
  • avoid misuse, neglect, abuse, alteration, tampering, unauthorized servicing, relocation, transfer, sale, lease, sublease, assignment, or encumbrance of the loaner unit;
  • return the loaner unit with all accessories, cords, handpieces, keys, foot pedals, filters, holders, attachments, manuals, and other items originally provided; and
  • comply with all applicable laws, regulations, licensing requirements, health requirements, local rules, and industry standards relating to operation and treatment use.

8. Return of Loaner Unit

The loaner unit must be returned promptly upon notice from SKINACT INC. that the customer’s repaired unit is ready, shipped, delivered, or otherwise available, or upon any request by SKINACT INC. under the terms of this program. Unless otherwise stated in writing, the customer must ship or make the loaner unit available for return within three (3) business days after such notice or delivery of the repaired original unit, whichever occurs first.

If the loaner unit is not returned on time, SKINACT INC. may assess late fees, deduct amounts from the temporary refundable security charge, charge additional amounts due, suspend support, deny future loaner eligibility, and pursue any other rights or remedies available by law or contract.

9. Condition of Returned Loaner Unit

The customer must return the loaner unit in substantially the same condition in which it was provided, ordinary wear excepted. The customer is responsible for all loss, theft, damage, contamination, misuse, missing parts, cosmetic damage beyond ordinary wear, broken components, unauthorized modifications, and damage caused by improper packing or shipping during return transit.

SKINACT INC. will determine the condition of the returned loaner unit upon inspection in its sole discretion.

10. Shipping, Handling, and Related Costs

Unless otherwise stated in writing, the customer is responsible for all shipping, freight, insurance, packaging, pickup, delivery, return shipping, and related handling costs associated with the loaner unit. SKINACT INC. may require the customer to use specific carriers, packaging methods, labels, pickup procedures, or insurance requirements.

Risk of loss for the loaner unit remains with the customer until the loaner unit is returned to and accepted by SKINACT INC.

11. No Business Interruption Guarantee

While this program is intended to help reduce downtime, SKINACT INC. does not guarantee uninterrupted operations, specific turnaround times, uninterrupted treatment schedules, revenue preservation, patient retention, appointment retention, or the availability of a loaner unit. SKINACT INC. shall not be liable for any delay, unavailability, cancellation, lost income, lost profits, lost business opportunity, loss of goodwill, scheduling disruption, or other business interruption losses.

12. No Medical, Treatment, or Professional Liability Assumed by SKINACT INC.

The customer acknowledges and agrees that the operation and use of any loaner unit are solely at the customer’s risk. SKINACT INC. does not supervise, control, direct, or participate in the customer’s treatments, procedures, operator decisions, patient or client screening, parameter selection, clinical judgment, sanitation practices, informed consent procedures, licensing compliance, or other professional activities.

SKINACT INC. shall not be responsible or liable for any injury, death, burn, scarring, adverse treatment outcome, malpractice claim, bodily injury claim, property damage claim, professional liability claim, product use claim, regulatory claim, or any other claim, loss, cost, or damage arising out of or related to the customer’s possession, operation, treatment use, handling, storage, transport, or maintenance of any loaner unit.

13. Customer Assumption of Risk

By accepting and using a loaner unit, the customer expressly assumes all risks associated with the possession, use, treatment application, transportation, setup, operation, storage, and return of the loaner unit. The customer is solely responsible for determining whether its personnel are properly trained and legally authorized to use the equipment and whether use of the equipment is appropriate for any patient, client, treatment, or procedure.

14. Indemnification

To the fullest extent permitted by law, the customer agrees to defend, indemnify, and hold harmless SKINACT INC., its owners, officers, directors, employees, affiliates, agents, contractors, successors, and assigns from and against any and all claims, demands, actions, liabilities, damages, judgments, penalties, fines, settlements, costs, and expenses, including reasonable attorneys’ fees and costs, arising out of or related to:

  • the customer’s possession, use, misuse, storage, transport, operation, servicing, or return of the loaner unit;
  • injury to any person, including patients, clients, employees, contractors, or third parties;
  • property damage of any kind;
  • violation of law, regulation, licensing requirement, or professional standard;
  • negligent acts, omissions, misconduct, or unauthorized acts of the customer or its personnel;
  • treatment outcomes or treatment-related claims of any kind; or
  • breach of these terms.

15. No Warranties Beyond Those Expressly Provided

Except as expressly stated in a written warranty provided by SKINACT INC., any loaner unit is provided “as is” and “as available,” without any additional warranties, representations, or guarantees of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, performance, uptime, compatibility, or uninterrupted operation.

16. Right to Deny, Delay, Limit, or Terminate Loaner Support

SKINACT INC. reserves the right, in its sole discretion, to deny, delay, limit, condition, suspend, or terminate loaner support at any time, including but not limited to cases involving product misuse, non-covered claims, account delinquency, missing documentation, customer non-cooperation, safety concerns, suspected abuse of the program, inventory limitations, shipping restrictions, regulatory concerns, prior damage history, or violation of these terms.

17. No Transfer or Assignment

Loaner support is provided only to the original purchasing customer and only for the covered equipment and location approved by SKINACT INC. The customer may not transfer, assign, lend, lease, sublease, relocate, or permit third-party use of the loaner unit without prior written approval from SKINACT INC.

18. Limitation of Liability

To the fullest extent permitted by law, SKINACT INC.’s total liability arising out of or relating to the loaner program, any loaner unit, or these terms shall not exceed the amount actually paid by the customer for the applicable extended warranty plan. In no event shall SKINACT INC. be liable for any indirect, incidental, consequential, special, exemplary, punitive, or business interruption damages, including lost revenue, lost profits, lost appointments, loss of goodwill, substitute equipment costs, or third-party claims.

19. Program Changes

SKINACT INC. reserves the right to modify, update, suspend, or discontinue this program or these terms at any time, provided that changes will not retroactively deprive a customer of benefits already approved in writing for an active covered event, except where required for safety, legal compliance, fraud prevention, inventory availability, or operational necessity.

20. Governing Terms

This program is subject to all other applicable sales terms, warranty terms, return policies, service policies, and terms of use published by SKINACT INC. To the extent of any conflict, SKINACT INC. may determine which terms apply to the specific transaction or claim, except where prohibited by law.

21. Acceptance

By purchasing an eligible extended warranty plan, paying the temporary refundable security charge, accepting delivery of a loaner unit, or using a loaner unit, the customer acknowledges that the customer has read, understood, and agreed to these terms and conditions.
