SKINACT® TERMS & CONDITIONS

Thank you for choosing SkinAct®. We are committed to providing professional-quality products, dependable service, and a positive purchasing experience.
These Terms & Conditions govern purchases from SkinAct and explain our policies concerning orders, payments, shipping, delivery, returns, exchanges, warranties, repairs, installation, maintenance, professional use, safety, privacy, artificial intelligence, SMS communications, and other important matters.
By placing an order, purchasing, accepting delivery of, accessing services relating to, or using a SkinAct product, the purchaser agrees to the applicable provisions of these Terms & Conditions.
60-DAY RETURN POLICY
60 DAYS TO RETURN ELIGIBLE PRODUCTS
SkinAct provides a 60-day return period for eligible products.
Unless otherwise stated for a particular product, eligible merchandise may be returned within 60 days from the original date of purchase, subject to the conditions, exclusions, and procedures described below.
We want our customers to be satisfied with their purchases and encourage customers to contact us promptly if they have any questions or concerns.
Return Requirements
To qualify for a return, merchandise must generally be:

Returned within the applicable 60-day return period;

Unused;
-
Unassembled;
-
Uninstalled;
-
Undamaged;
-
Clean and in resalable condition;
-
Returned in its original packaging;
-
Returned with all original accessories, components, manuals, hardware, tags, security tags, and included materials; and
-
Accompanied by a valid Return Merchandise Authorization ("RMA") issued by SkinAct.
All returns require prior authorization from SkinAct.
Customers must contact SkinAct before shipping or delivering merchandise back to us to obtain an RMA number and applicable return instructions.
Returns sent without authorization or without a valid RMA may be refused or returned to the sender.
OPENED PRODUCTS & RESTOCKING FEES
Opening packaging does not automatically make a product ineligible for return unless the product falls within a non-returnable category.
However, returned merchandise may be subject to a restocking fee based on its condition.
Restocking fees may range from 15% up to 80% depending upon factors including:

Condition of the product;

Condition of the original packaging;
-
Missing packaging or components;
-
Assembly;
-
Installation;
-
Signs of use;
-
Cosmetic damage;
-
Cleaning requirements;
-
Inspection requirements;
-
Repackaging;
-
Refurbishment;

Missing manuals, accessories, hardware, or parts; and
-
Reduction in resale value.
Products that have been used, assembled, installed, modified, damaged, or materially altered may be refused for return.
SkinAct reserves the right to inspect returned merchandise before determining return eligibility and the applicable refund or restocking fee.
NON-RETURNABLE PRODUCTS
Unless otherwise required by applicable law, the following products are generally not eligible for return:

Used products;

Installed equipment;

Assembled equipment;

Parts and replacement parts;

Custom-made products;
-
Custom upholstery or custom-color products;
-
Special-order products after production or procurement has begun;

Products modified or altered at the customer's request;

Products damaged after delivery;

Products damaged through misuse or improper maintenance;
-
Products damaged through improper installation;
-
Products subjected to unauthorized modification or repair;
-
Products that cannot reasonably be resold because of their condition; and
-
Items specifically designated as final sale or non-returnable at the time of purchase.
Open-box, floor-model, demonstration, reconditioned, clearance, or similar merchandise may have separate return conditions and may be sold as-is when clearly identified as such.
SKINCARE, SANITARY, DISPOSABLE & PERSONAL-CARE PRODUCTS
For health, hygiene, and safety reasons, opened or used skincare products, sanitary products, disposable products, personal-care products, apparel where hygiene is implicated, and products that come into direct contact with the body may not be returned or exchanged once opened or used.
This policy protects our customers and professional users by helping ensure that sanitary products have not previously been used or contaminated.
If you are uncertain whether a product is returnable, please contact SkinAct before opening, assembling, installing, or using it.
REFUNDS
After an eligible return is received and inspected, SkinAct will determine whether it satisfies the applicable return requirements.
Approved refunds will generally be issued to the original method of payment, less applicable:

Restocking fees;

Shipping or freight charges;
-
Delivery charges;
-
Installation or assembly charges;
-
Special-handling charges; and
-
Other non-refundable charges associated with the transaction.
Depending on the financial institution, customers should generally allow approximately 2–10 business days after SkinAct processes a refund for the credit to appear.
Financed purchases may be subject to the terms and refund procedures of the applicable financing provider. Where the financing arrangement does not permit a cash refund to the customer, an applicable credit may be issued in accordance with the financing arrangement and applicable law.
EXCHANGES
Eligible merchandise may be exchanged within the applicable return period.
To help customers receive replacement merchandise quickly, SkinAct may process the replacement as a new order.
Once the original qualifying product has been received, inspected, and approved, the applicable refund or credit will be processed according to these Terms and the original method of payment.
ORDER CANCELLATIONS
We understand that plans sometimes change. Customers should contact SkinAct as soon as possible if they need to cancel an order.
Orders that have already entered processing, preparation, production, procurement, customization, packaging, or shipment may not be cancelable or may be subject to cancellation or restocking charges.
A cancellation fee of up to 15% may apply to orders for which SkinAct has already incurred processing, procurement, preparation, administrative, manufacturing, or other costs.
Orders may no longer be cancelable after 24 hours where processing, production, procurement, or fulfillment has begun.
Custom and special-order products generally cannot be canceled once production or procurement has begun.
Deposits associated with custom or special-order products may become non-refundable after SkinAct or its manufacturer has committed resources toward fulfilling the order.
ORDERS & PAYMENT
All purchases must be paid according to the payment terms applicable to the order.

Certified bank checks;

Money orders;
-
Approved financing; and
-
Other payment methods specifically accepted by SkinAct.
COD orders are not accepted unless specifically authorized.
Special-order products and products not currently in stock may require a deposit, with the remaining balance due before shipment, delivery, or pickup.
Once a special or custom order has entered production, the customer remains responsible for amounts due under the applicable order terms.
Returned or rejected checks and payments may be subject to applicable bank, administrative, and processing charges.
STORAGE & UNCLAIMED ORDERS
Products purchased for customer pickup or held at the customer's request must be picked up, shipped, or otherwise arranged for delivery within the agreed period.
If merchandise remains at a SkinAct facility for more than three weeks after it becomes available for pickup or shipment, SkinAct may charge reasonable storage fees, which may begin at $35 per day, after applicable notice.
Customers should promptly respond to pickup, shipping, payment, repair, and service notices.
PRODUCT APPEARANCE, COLORS, UPHOLSTERY, MATERIALS & SPECIFICATIONS
SkinAct makes reasonable efforts to accurately display and describe its products.
However, actual:

Colors;
-
Shades;
-
Undertones;
-
Upholstery;
-
Finishes;
-
Textures;
-
Materials;
-
Dimensions;
-
Components;
-
Hardware; and
-
Other product characteristics
may vary from website images, showroom displays, swatches, samples, catalogs, or previous purchases.
Variations may result from photography, lighting, monitor settings, production batches, dye lots, manufacturing processes, supplier changes, material availability, and continuing product improvements.
SkinAct and its manufacturing partners may periodically update, improve, modify, or substitute product designs, upholstery, colors, materials, parts, finishes, components, or specifications without prior notice, provided the change does not materially alter the product's primary intended function.
Changes may include improved upholstery, improved stain or marking resistance, improved durability, upgraded components, safety improvements, or other product enhancements.
Reasonable manufacturing, material, shade, texture, or production-batch variations are not necessarily defects or incorrect shipments.
Customers attempting to match existing equipment, a previous purchase, upholstery, colors, finishes, or materials should contact SkinAct before ordering.
Samples or swatches may be available upon request and subject to availability.
Returns based on color preference, shade variation, undertone differences, production-batch variation, or failure to match existing equipment are treated as standard returns and remain subject to applicable return requirements and fees.
PROFESSIONAL USE ONLY
ALL SKINACT PRODUCTS AND EQUIPMENT ARE DESIGNED, MANUFACTURED, MARKETED, AND SOLD FOR PROFESSIONAL USE ONLY.
SkinAct products and equipment are intended for use by appropriately trained, qualified, certified, and/or licensed professionals, as applicable to the particular product, treatment, service, profession, and jurisdiction.
SkinAct products are not intended for general consumer, household, recreational, or unsupervised personal use, unless SkinAct expressly identifies a particular product as suitable for such use.
The purchaser is responsible for ensuring that SkinAct products are provided only to individuals who are properly trained and qualified to operate them.
Professional Responsibility
By purchasing, installing, operating, supervising, or using SkinAct products, the purchaser, business, and operator acknowledge responsibility for ensuring that anyone operating the product possesses the appropriate:

Training;
-
Professional knowledge;
-
Experience;
-
Certification;
-
Licensing;
-
Permits; and
-
Other qualifications
required for the product, service, procedure, treatment, and jurisdiction.
Professional operators are responsible for:

Understanding the proper operation and intended use of equipment before use;
-
Reading and following all manuals and operating instructions;
-
Following warnings, contraindications, maintenance requirements, and safety information;
-
Obtaining all required professional licenses and certifications;
-
Obtaining required permits;
-
Determining whether a product or treatment is appropriate for a particular client;
-
Following federal, state, and local laws and regulations;
-
Following applicable professional standards;
-
Properly supervising clients;
-
Properly cleaning and disinfecting equipment;
-
Properly installing and maintaining equipment;
-
Conducting appropriate equipment inspections;
-
Maintaining a safe professional environment; and
-
Immediately discontinuing use of equipment that appears unsafe.
PURCHASE DOES NOT CONSTITUTE PROFESSIONAL QUALIFICATION
Purchasing or possessing a SkinAct product does not constitute professional training, certification, licensure, authorization, medical qualification, or approval to perform any treatment, service, or procedure.
SkinAct does not control the manner in which independently operated businesses, professionals, practitioners, estheticians, technicians, salons, spas, schools, medical offices, or other purchasers use its products.
The professional operator and business are responsible for client assessment, treatment selection, sanitation, supervision, professional judgment, equipment operation, and compliance with applicable professional and regulatory requirements.
Use of SkinAct products by an untrained, unqualified, unlicensed, or unauthorized individual, where applicable, or use contrary to instructions, warnings, intended purpose, or professional requirements may result in injury, product damage, or property damage and may affect warranty coverage to the extent permitted by law.
IF YOU ARE NOT APPROPRIATELY TRAINED OR QUALIFIED TO OPERATE A SKINACT PRODUCT, DO NOT USE THE PRODUCT UNTIL YOU HAVE RECEIVED APPROPRIATE PROFESSIONAL TRAINING AND INSTRUCTION.
LOCAL LAWS, CODES, PERMITS & REGULATORY REQUIREMENTS
Requirements governing professional equipment, treatments, electrical installations, plumbing, accessibility, sanitation, licensing, and building construction vary by jurisdiction.
The purchaser and professional operator are responsible for determining and complying with all applicable:

Federal requirements;
-
State requirements;
-
Local laws;
-
Building codes;
-
Electrical codes;
-
Plumbing codes;
-
Health regulations;
-
Accessibility requirements;
-
Professional licensing requirements;
-
Permitting requirements; and
-
Inspection requirements.
SkinAct does not represent that a particular product, treatment, or installation satisfies every local code, licensing requirement, inspection requirement, or professional regulation applicable to every customer.
Customers should consult the appropriate licensed professionals and governmental authorities when necessary.
LIMITED WARRANTY
Unless otherwise specifically stated for a particular product, qualifying SkinAct equipment includes a 1-Year Limited Warranty from the invoice date.
The warranty applies to qualifying manufacturing defects and product malfunctions occurring during normal professional use.
Certain products may expressly include a longer or Lifetime Limited Warranty. When a product is specifically sold with such coverage, the stated warranty duration applies while all applicable limitations, exclusions, professional-use requirements, installation requirements, and maintenance obligations remain in effect.
Unless otherwise specifically stated, electronics and hydraulic pumps are covered for 180 days from the date of purchase.
Warranty Does Not Cover
The warranty does not cover damage or malfunction resulting from:

Abuse;

Misuse;
-
Normal wear and tear;
-
Improper installation;
-
Improper operation;
-
Accidents;
-
Alteration;
-
Unauthorized modification;
-
Unauthorized repair;
-
Improper or inadequate maintenance;
-
Water or moisture damage;
-
Fire;
-
Freezing;
-
Environmental exposure;
-
Improper storage;
-
Cosmetic wear;
-
Chipping, fading, or peeling caused by use or environmental conditions;
-
Failure to follow instructions;
-
Failure to perform required maintenance; or
-
Use inconsistent with the product's intended professional purpose.
Wearable components such as hoses, seals, fittings, upholstery, and similar components may require routine replacement and are not necessarily considered defective because they wear through normal professional use.
WARRANTY CLAIM REQUIREMENTS
Customers requesting warranty service may be required to provide:

Proof of purchase;
-
Serial number;
-
Photographs;
-
Video;
-
Description of the issue;
-
Original shipping information;
-
Installation documentation;
-
Maintenance records;
-
Technician information; and
-
Other reasonable information needed to diagnose or verify the claim.
Defects or damage reasonably discoverable at delivery should be reported as soon as possible, preferably within 24 hours.
SkinAct may require a Return Merchandise Authorization before merchandise is returned.
Depending upon the product and circumstances, warranty service may consist of:

Technical troubleshooting;
-
Replacement parts;
-
Repair;
-
Replacement; or
-
Another commercially reasonable solution determined by SkinAct.
For large equipment, warranty coverage may be limited to providing qualifying replacement parts.
Unless expressly approved by SkinAct in writing, warranty coverage does not include third-party labor, technician visits, removal, reinstallation, transportation, lost business, or other incidental expenses.
Shipping and transportation costs associated with warranty service may be the customer's responsibility except where otherwise stated or required by applicable law.
SHIPPING DAMAGE, DEFECTS & RECEIVING RESPONSIBILITY
Customers should carefully inspect merchandise when it arrives.
For freight shipments, do not sign the carrier's delivery receipt without inspecting the shipment for visible damage whenever reasonably possible.
If packaging or merchandise appears damaged:

Photograph the packaging and merchandise;
-
Clearly note the damage on the carrier's delivery receipt;
-
Retain the original packaging and shipping materials; and
-
Contact SkinAct promptly.
If merchandise is seriously damaged, the customer may be instructed to refuse delivery and note "Refused Due to Damage" on the delivery receipt.
Shipping damage, missing merchandise, incorrect merchandise, or defects reasonably discoverable upon delivery should be reported to SkinAct as soon as possible, preferably within 24 hours of delivery, so that SkinAct can promptly investigate and assist with the claim.
Original packaging, photographs, tracking information, and delivery documentation may be necessary to process carrier or damage claims.
SkinAct will make reasonable efforts to assist customers with legitimate shipping damage and product defect claims.
SHIPPING & DELIVERY
SkinAct works to deliver orders safely and efficiently.
Processing, availability, and delivery dates are estimates.
Timing may vary because of:

Product availability;
-
Order volume;
-
Manufacturing;
-
Carrier schedules;
-
Weather;
-
Customs;
-
Supply-chain conditions;
-
Special orders;
-
Backorders;
-
Transportation delays; and
-
Circumstances outside SkinAct's reasonable control.
Some orders may require extended production or delivery periods.
Standard parcel shipments may be shipped through UPS or another carrier selected by SkinAct.
Expedited shipping methods may be available when requested and paid for by the customer.
CURBSIDE FREIGHT DELIVERY
Unless another service has specifically been purchased or arranged, standard freight delivery is curbside delivery.
Curbside delivery generally means delivery to the curb or accessible delivery point at the customer's location.
It does not include:

Inside delivery;
-
Installation;
-
Assembly;
-
Placement inside a building;
-
Movement upstairs or through restricted spaces;
-
Removal of packaging; or
-
Disposal of existing equipment.
A delivery appointment may be required.
Customers are responsible for ensuring that the delivery location is accessible to the carrier.
A signature may be required.
Liftgate service may be recommended or required for certain large products and may involve an additional charge.
Limited-access locations, redelivery, missed appointments, storage, address corrections, unusual access conditions, or other special delivery requirements may result in additional carrier charges.
CUSTOMER RESPONSIBILITY FOR DELIVERY
The customer is responsible for providing accurate delivery information and for making reasonable arrangements to receive the shipment.
If a delivery location, driveway, road, entrance, loading area, or other access point cannot safely accommodate the delivery vehicle, the carrier may be unable to complete delivery.
Additional charges resulting from inaccessible delivery locations, missed appointments, customer-requested changes, or redelivery may be the customer's responsibility.
ORDERS OUTSIDE THE CONTIGUOUS UNITED STATES
Standard shipping promotions generally apply only within the contiguous 48 United States unless otherwise stated.
Orders shipped to Alaska, Hawaii, Puerto Rico, U.S. territories, Canada, or international destinations may be subject to different shipping methods, costs, payment requirements, and delivery times.
International customers are responsible for:

Customs clearance;

Customs duties;
-
Import taxes;
-
Brokerage charges;
-
Destination-country fees;
-
Import requirements; and
-
Other governmental or carrier charges.
Unless otherwise expressly agreed in writing, warranty-related shipping charges outside the contiguous United States are the customer's responsibility.
PRO MEMBERSHIP
SkinAct may offer a paid Pro Membership program providing qualifying customers with promotional benefits.
Benefits may include:

Free standard shipping on qualifying merchandise;
-
Member pricing;
-
Promotional discounts;
-
Special offers; and
-
Other benefits announced by SkinAct.
Pro Membership free standard shipping applies only within the contiguous 48 United States and only to qualifying products.
Products, promotions, discounts, benefits, and eligible merchandise may change from time to time.
Membership Term & Renewal
Unless otherwise stated when enrolling, an annual Pro Membership remains active for 12 months beginning on the enrollment date.
If automatic renewal is selected or disclosed at enrollment, membership may renew for additional 12-month periods at the applicable membership rate unless canceled in accordance with the cancellation procedures provided by SkinAct.
Membership Cancellation
A membership may generally be canceled within 60 days when membership benefits have not been used.
Once membership benefits, promotions, discounts, or free shipping have been used, refunds of membership fees may be restricted to the extent permitted by applicable law and the membership terms presented at enrollment.
PROFESSIONAL INSTALLATION
Products requiring plumbing, electrical connections, anchoring, drainage, ventilation, or other specialized installation must be installed by appropriately licensed or qualified professionals where required.
Improper installation can cause:

Product damage;
-
Water damage;
-
Electrical hazards;
-
Fire;
-
Property damage;
-
Personal injury; and
-
Loss of warranty coverage.
Customers are responsible for ensuring that installation is appropriate for the location and complies with applicable codes and requirements.
SkinAct does not provide installation or assembly unless specifically agreed to in writing.
ELECTRICAL EQUIPMENT
Electrical equipment must be installed, connected, operated, inspected, and serviced according to product instructions and applicable electrical codes.
Where professional electrical service is required, an appropriately licensed or qualified electrician must perform the work.
Unauthorized electrical modification or improper electrical installation may void warranty coverage and create a serious safety hazard.
Customers should never modify plugs, wiring, grounding systems, safety devices, switches, motors, actuators, or other electrical components unless specifically authorized by SkinAct and performed by an appropriately qualified professional.
PLUMBING-CONNECTED EQUIPMENT
All plumbing-related equipment must be installed by an appropriately licensed plumber where required.
Proof of professional installation may be required for plumbing-related warranty claims.
Where applicable, plumbing installations should include appropriate:

Shut-off valves;
-
Leak detection;
-
Drainage;
-
Drain pans;
-
Backflow protection;
-
Sealing;
-
Anchoring; and
-
Other safeguards required by applicable codes or installation conditions.
Shampoo chairs and permanently plumbed equipment must be properly secured to prevent shifting and unnecessary stress on plumbing connections.
Plumbed equipment should not be moved after installation unless it is designed for movement and the plumbing system has been properly disconnected and reinstalled by a qualified professional.
Unauthorized alteration of plumbing lines, hoses, valves, fittings, or other components may affect warranty coverage.
Customers are responsible for ensuring that installation areas are water-resistant, properly drained where appropriate, and suitable for plumbing-connected professional equipment.
MAINTENANCE REQUIREMENTS
Professional equipment requires routine inspection and preventive maintenance.
Customers are responsible for maintaining equipment in safe and proper working condition.
Equipment should generally be professionally inspected and maintained at least every 12 months, and more frequently where product instructions, usage levels, or operating conditions require it.
Regular maintenance helps improve equipment safety, reliability, and service life.
Customers should regularly inspect:

Electrical connections;
-
Power cords;
-
Controls;
-
Motors;
-
Actuators;
-
Hydraulic components;
-
Hoses;
-
Flexible water lines;
-
Fittings;
-
Seals;
-
Fasteners;
-
Moving components;
-
Plumbing connections;
-
Drain components; and
-
Safety devices.
High-use professional environments may require substantially more frequent maintenance.
PLUMBING EQUIPMENT MAINTENANCE
For plumbing-connected equipment, customers should:

Inspect hoses, fittings, seals, and plumbing connections regularly;
-
Check for corrosion, leaks, deterioration, or stress;
-
Replace worn or damaged components promptly;
-
Routinely clean filters, jets, drains, and water channels;
-
Drain and flush tanks or water systems as appropriate;
-
Keep equipment securely anchored;
-
Inspect electrical systems where applicable; and
-
Replace flexible hoses and connectors according to manufacturer recommendations and usage conditions.
Flexible hoses, fittings, seals, and water-contact components are wearable components and require periodic replacement.
MAINTENANCE RECORDS
Customers should maintain reasonable maintenance and service records for professional equipment.
For equipment where warranty coverage depends upon installation or maintenance, SkinAct may request records including:

Date of inspection or service;
-
Type of service performed;
-
Technician or service-provider information;
-
Parts replaced;
-
Installation records;
-
Maintenance records; and
-
Photographs where appropriate.
Failure to provide reasonably requested maintenance documentation may affect a warranty claim when maintenance is relevant to the reported failure.
EXPECTED COMPONENT LIFE & WEAR
Professional equipment components naturally wear over time.
Actual component life depends upon usage frequency, operating conditions, water quality, maintenance, environment, installation, and other factors.
Typical maintenance considerations may include:

Flexible water hoses: inspect regularly and replace periodically;
-
Drain fittings and traps: clean and inspect regularly;
-
Spray nozzles: clean frequently to prevent mineral buildup;
-
Electric actuators: keep clean and properly maintained;
-
Ceramic and porcelain components: avoid harsh impacts and inappropriate chemicals;
-
Seals and fittings: inspect for leaks and deterioration; and
-
Electrical components: inspect and service as appropriate.
Any expected lifespan information supplied by SkinAct is an estimate and is not a guarantee that a component will last for a particular period.
ROTATING FACIAL BEDS & TREATMENT TABLES
Rotating hydraulic and electric facial beds and treatment tables must be used carefully by trained professionals.
To promote safe operation:

Place the bed on a level, stable, non-slip surface;
-
Properly adjust all leveling feet;
-
Keep the bed appropriately aligned with its base during treatment as instructed;
-
Whenever practical, rotate the bed without a client on it;
-
If rotation with a client is necessary and permitted by the product instructions, position and support the client appropriately;
-
Follow all product-specific instructions concerning rotation;
-
Never sit or place excessive weight on unsupported head or foot sections; and
-
Never use equipment in an unstable orientation.
Facial beds and treatment tables should be used only for their intended professional purpose.
Some hydraulic or electric facial beds are not designed for massage or excessive downward pressure. Applying unintended loads may affect stability and cause injury or equipment damage.
STEAMER SAFETY
SkinAct professional steamers must be operated only by trained professionals who understand the risks associated with hot steam, heated water, electricity, and pressurized components.
Operators must read and follow the instructions supplied with the applicable steamer.
General precautions include:

Use a properly grounded electrical outlet;
-
Do not improperly modify the plug or electrical system;
-
Never direct steam toward an unintended person;
-
Maintain the appropriate distance and angle from the client's skin as specified for the product;
-
Never position a steam nozzle in a manner prohibited by the product instructions;
-
Never leave operating equipment unattended;
-
Keep children and unauthorized individuals away from professional equipment;
-
Disconnect power before servicing, filling, draining, or transporting equipment where instructed;
-
Exercise extreme caution around hot water and steam;
-
Allow equipment to cool before servicing or draining; and
-
Immediately discontinue use if the equipment appears unsafe or malfunctions.
Never disable, remove, obscure, or modify safety warnings or safety devices.
STEAMER MAINTENANCE
Unless specifically designed for such use, do not place essential oils, herbs, chemicals, or unauthorized substances directly into a steamer water reservoir.
Such materials may cause:

Clogging;
-
Excessive water discharge;
-
Pressure problems;

REPAIR & AFTER-WARRANTY SERVICE
SkinAct may provide paid repair, diagnostic, and service options for eligible authentic SkinAct-branded products.
Products within an applicable warranty period are serviced according to the warranty terms.
Products outside warranty are not eligible for free repair, replacement, or return solely because of a malfunction.
After-Warranty Charges
After-warranty service may include:

Technician labor starting at $125 per hour, with a one-hour minimum;

Diagnostic evaluation fee starting at $75;
-
Parts and materials charged separately; and
-
Applicable shipping or transportation charges.
The diagnostic fee may be credited toward an approved repair when SkinAct expressly provides for such credit.
Rates may change from time to time.
Repair Eligibility
SkinAct may determine whether a product is reasonably eligible for repair.
Repair may be declined when:

The product cannot be verified as authentic SkinAct merchandise;

The product has been materially altered or tampered with;
-
Unauthorized repairs have been performed;
-
Required parts are unavailable;
-
Repair would be unsafe;
-
Repair is technically impractical; or
-
Repair cost would be economically unreasonable relative to the product's value.
Products with relatively low original retail value, including products under approximately $200, may not be economical to repair.
SkinAct may recommend replacement rather than repair.
Customer Authorization
No chargeable repair work will be performed without customer authorization.
By submitting merchandise for diagnosis, the customer authorizes SkinAct to inspect and evaluate the product and acknowledges that applicable diagnostic and shipping fees may apply even when the customer declines the recommended repair.
No Guarantee of Repair Outcome
Repair services are performed using commercially reasonable efforts.
SkinAct cannot guarantee:

That every product can be repaired;
-
That replacement parts will remain available indefinitely; or
-
That repaired merchandise can be restored to its exact original or like-new condition.
REPAIR SHIPPING & RISK
Customers are responsible for properly packaging products sent to SkinAct for service.
Unless otherwise agreed, customers are responsible for shipping charges to and from SkinAct for after-warranty service.
SkinAct is not responsible for transit damage caused by inadequate customer packaging or carrier handling outside SkinAct's control.
Customers should insure valuable shipments where appropriate and retain tracking information.
CUSTOMER PROPERTY LEFT FOR SERVICE
Customers should promptly respond to diagnostic results, repair estimates, payment requests, and notices that equipment is ready for pickup or return shipment.
Products not approved, paid for, picked up, or otherwise claimed after notice may be subject to storage charges and handled in accordance with applicable law.
Where legally permitted and after required notice, abandoned property may ultimately be recycled, disposed of, or otherwise handled as permitted by law.
PAYMENT DISPUTES & CHARGEBACKS
If a customer has a concern regarding a charge, order, shipment, return, warranty, or product, we strongly encourage the customer to contact SkinAct Customer Service first so that we can investigate and attempt to resolve the matter.
Fraudulent, abusive, or improper payment disputes or chargebacks may affect account privileges and claims relating to the disputed transaction to the extent permitted by applicable law.
SkinAct reserves the right to provide transaction records, order documentation, delivery confirmation, customer communications, acceptance records, photographs, and other relevant evidence to financial institutions, payment processors, or card networks when responding to a payment dispute.
Nothing in these Terms is intended to restrict a customer's rights under applicable law or applicable payment-card network rules.

SkinAct may use artificial intelligence ("AI"), machine learning, automation, or third-party AI technology in connection with certain:

Nothing in these Terms excludes or limits liability or customer rights that cannot legally be excluded or limited.
RIGHT TO DECLINE UNSAFE OR IMPRACTICAL SERVICE
SkinAct may decline repair, technical service, installation-related assistance, or other requested services where SkinAct reasonably determines that:

Equipment has been dangerously modified;

Continued operation would be unsafe;

Required parts are unavailable;
-
Repair is technically impractical;
-
The requested work falls outside SkinAct's services;

The equipment cannot be authenticated; or
-
Providing the requested service would violate applicable requirements.
This provision does not limit rights that customers may have under applicable law.
CHANGES TO THESE TERMS
SkinAct may periodically update these Terms & Conditions to reflect changes in products, technology, services, safety requirements, business practices, or applicable laws and regulations.
The Terms applicable to a purchase will generally be the Terms in effect when the order was placed, except where a subsequent change is required by applicable law or otherwise agreed to by the customer.
SkinAct may publish updated Terms on its website.
SEVERABILITY
If any provision of these Terms is determined by a court or other authority of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision will be interpreted or limited to the extent necessary to make it enforceable where permitted, and the remaining provisions will continue in effect.
NO WAIVER
SkinAct's decision not to enforce a provision of these Terms in a particular situation does not constitute a waiver of that provision or SkinAct's right to enforce it in another situation.
SkinAct may make reasonable exceptions to its policies based upon individual circumstances without creating an obligation to make the same exception in other cases.
